Terms of Use

These Terms of Use ("Terms") are a contract between you and NuHouse Empreendimentos e Participações Ltda., a company registered in Brazil under CNPJ 32.151.695/0001-07, with its registered office at Rua Henrique Meyer, 280, Sala 505, Joinville-SC, 89201-405, Brazil ("NuHouse", "we", "us"). They govern the Etch application for iOS and macOS and the services behind it (together, "Etch").
These Terms are published at useetch.com/terms and are linked from the subscription screen inside the
app, so that they are available to you before you contract, as required by article 46 of the Código de
Defesa do Consumidor (Consumer Protection Code, Federal Law No. 8.078/1990, the "CDC").
You accept these Terms by creating an Etch account or by using Etch. If you do not accept them, do not use Etch.
1. Definitions
"App" — the Etch application for iOS and macOS, distributed through the Apple App Store.
"Apple" — Apple Inc. and its affiliates, including the entity that sells you the App and any subscription.
"Item" — a single record in your Library: a Link, the metadata Etch read from the Platform (author, handle, caption, publication date), a thumbnail image, any note you write, any folders and tags you assign, and any AI Output generated for it.
"Library" — all of your Items.
"Link" — a URL to a post on a Platform.
"Platform" — Instagram, TikTok or YouTube, or any other service Etch later supports.
"AI Output" — text produced by an automated model at your request: a description written from an Item's thumbnail and caption, tags, and answers given in conversation mode.
"Free Plan" — use of Etch without a subscription, as described in clause 6.
"Etch Pro" — the auto-renewing subscription described in clause 7.
2. What Etch is, and what it is not
2.1. Etch is a personal library for links you save from Platforms. It stores the Link, the metadata around it, a thumbnail image, and anything you add yourself, so that you can find an item again by describing it in your own words.
2.2. Etch does not download, store, copy, transcode, cache, host, stream or play video or audio files. The video remains on the Platform that hosts it. Opening an Item opens that Platform, in its own app or in your browser. Etch is not a downloader, and it must not be used as one.
2.3. Etch downloads and stores one copy of an Item's thumbnail image because the address the Platform serves it from expires within a few days. This copy is stored in your own iCloud account, is shown only to you, and is not published or redistributed by us.
2.4. Etch reads only pages that a Platform serves publicly, without credentials. It does not log in to a Platform on your behalf, does not use your Platform account, and does not access anything that is private to you or to anyone else on a Platform.
3. Acceptance, eligibility and your account
3.1. Etch is a general-audience product and is not directed at children. You must be at least 12 years old to use Etch, which matches the floor stated in our Privacy Policy: we do not knowingly process the personal data of a child under 12 within the meaning of the Estatuto da Criança e do Adolescente (Statute of the Child and Adolescent, Federal Law No. 8.069/1990).
3.2. Under Brazilian law a person under 16 cannot contract on their own, and a person aged 16 or 17 needs their legal representative's assistance (Código Civil — Civil Code, Federal Law No. 10.406/2002, articles 3 and 4). If you are under 18 you may use Etch only with the consent of your parent or legal guardian, and any purchase must be made by that adult, including through Apple's Family Sharing and Ask to Buy.
3.3. Etch requires Sign in with Apple. One Apple Account is one Etch account. The one-time allowance in clause 6.1(c) is counted against that account, on our servers. The monthly allowances in clause 7.9 are counted against the subscription itself, so one subscription has one allowance across all of your devices. The monthly save limit in clause 6.1(a) is counted by the App on each device you use.
3.4. Signing in gives us an opaque identifier that Apple generates for Etch and for no other app. It is the only identifier we hold about you. What we do with it is described in our Privacy Policy, which forms part of these Terms.
3.5. You are responsible for keeping access to your Apple Account secure, and for activity carried out through your Etch account.
4. Your Library and your content
4.1. Your Library is stored in your own iCloud account, in a database that only your Apple Account can open. We do not host it and we cannot read it. It follows Apple's iCloud terms and counts against your iCloud storage.
4.2. Because we cannot read your Library, we cannot recover, restore or export it for you. Backups are Apple's iCloud feature, not ours.
4.3. Your Library is yours. We claim no ownership of it. You grant us only a limited, non-exclusive, worldwide, royalty-free licence to process a Link, its metadata, its thumbnail, and any note you write, strictly to provide the features you have asked for, and only for as long as it takes to answer that request. The Privacy Policy names the third parties involved and what each of them receives.
4.4. You are responsible for having the right to access what you save. Etch is a tool for organising links you are already able to open. Saving a Link does not give you any right to the content behind it, and it does not change the terms under which the Platform makes that content available to you.
5. Acceptable use
5.1. You agree not to:
- a) use Etch to obtain, extract, reproduce or redistribute video, audio or images beyond the personal use described in these Terms, or in any way a Platform's own terms prohibit;
- b) use Etch to collect content at scale, whether manually or by automated means;
- c) save content that is unlawful to possess or distribute, or that infringes another person's rights;
- d) circumvent, or attempt to circumvent, the save limits or the AI allowances, including by creating additional accounts for that purpose;
- e) attack, overload, probe or attempt to gain unauthorised access to our servers or to any service we depend on;
- f) reverse engineer, decompile or modify the App, except to the extent that Brazilian law expressly permits it despite this restriction.
5.2. We do not monitor your Library and we have no obligation to review what you save.
6. The Free Plan
6.1. On the Free Plan, Etch provides:
- a) 15 saves per calendar month, counted by the App on each device you use. The count is kept on the device and is not synchronised between your devices, so each device has its own. A save that is a duplicate of an Item you already have does not count, because Etch surfaces the existing Item instead of creating a second one.
- b) Search across your whole Library, on every plan, with no monthly limit. Search runs on your device, over your own Items.
- c) 25 AI descriptions, once. This is a one-time allowance granted per account. It is not renewed monthly and it is not renewed by reinstalling the App.
- d) No limit on the size of your Library. Etch imposes none; your iCloud storage is the practical ceiling, and that is between you and Apple.
6.2. A save beyond the monthly 15 is still accepted. Etch stores the Link and marks the Item as waiting: no metadata is fetched, no thumbnail is downloaded and no AI is used. Waiting Items are processed automatically the next time you open the App once your allowance has renewed at the start of the following calendar month, up to that month's allowance, and all of them at once if you subscribe to Etch Pro. Nothing you send to Etch is discarded for being over a limit.
6.3. Once your 25 AI descriptions are used, new Items are still saved, still get their metadata and thumbnail, and remain searchable. They are not given an AI description, and are not described later automatically.
7. Etch Pro — subscription terms
7.1. Title. The subscription is called Etch Pro.
7.2. What it includes. Etch Pro unlocks AI descriptions for the Items you save, conversation mode (prose answers drawn from your own Library), and the capture features of the macOS app: the menu bar panel, the global keyboard shortcut and optional clipboard detection. The macOS app itself is free and is not behind the subscription.
7.3. Periods. Etch Pro is offered as an auto-renewing subscription with a period of one month or one year. You choose the period when you subscribe.
7.4. Price. The price of each period is shown in the App and on the App Store, in your local currency, before you confirm the purchase. Prices vary by storefront and may be changed as described in clause 7.11.
7.5. Payment. Payment is charged to your Apple Account at confirmation of purchase.
7.6. Automatic renewal. The subscription renews automatically for the same period at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours prior to the end of the current period.
7.7. Managing and cancelling. You manage and cancel Etch Pro in Apple's own settings: on iOS, in Settings → your name → Subscriptions; on macOS, in the App Store app → your name → Account Settings. Cancellation takes effect at the end of the period already paid for. We cannot cancel a subscription for you, and we never see your payment details.
7.8. No free trial. Etch Pro is not sold with a free trial period. The 25 AI descriptions in clause 6.1(c) are available on the Free Plan and are not part of the subscription.
7.9. Fair use. Etch Pro includes up to 250 AI-described Items and 200 conversation messages per calendar month. These limits exist to keep one account from exhausting a shared processing budget. Above them, and until the allowance resets at the start of the next calendar month:
- a) saving continues without change, and the Item still receives its metadata and thumbnail;
- b) search continues without change, over your whole Library;
- c) no AI description is written for further Items that month, and Items saved over the limit are not described later automatically;
- d) conversation mode is unavailable until the allowance resets.
7.10. If you cancel. Your Library is kept in full and stays searchable. Your account returns to the Free Plan described in clause 6, including its 15 new saves per month. Cancelling Etch Pro does not delete any Item.
7.11. Price changes. We may change the price of Etch Pro. A change never affects a period already paid for. It applies only from a renewal after Apple has given you notice under its own rules, which in some cases require your explicit consent before the renewal is charged. If you do not accept a new price, cancel before the renewal under clause 7.7.
7.12. Apple's role. Etch Pro is sold through the App Store. Apple processes the purchase and the renewals, and Apple's Media Services Terms and Conditions apply to the transaction. Your licence to use the App is Apple's standard Licensed Application End User License Agreement; where that licence and these Terms conflict on the terms of the licence itself, Apple's prevails. Apple is not a party to these Terms.
8. Right of regret and refunds
8.1. Seven-day right of regret. Because Etch Pro is purchased at a distance, article 49 of the CDC gives you seven days from the purchase to withdraw from it, without having to give a reason and without penalty, with the return of any amount paid, monetarily adjusted.
8.2. How to exercise it. Request a refund from Apple at reportaproblem.apple.com, which is the fastest route, and turn off auto-renewal as described in clause 7.7 so that the subscription does not renew. Tell us as well, at contact@useetch.com, within the same seven days. We will confirm your withdrawal in writing and support your refund request with Apple. We cannot stop Apple's billing or end the subscription for you — only you and Apple can do that, which is why clause 7.7 matters here.
8.3. Refunds outside that period are administered by Apple under its own policy. We do not receive your payment directly and therefore cannot issue a refund ourselves.
8.4. Nothing in this clause restricts the rights the CDC gives you, which apply regardless of what this page says.
9. AI Output
9.1. AI Output is generated automatically by a machine, not written by a person, and Etch labels it as such in the interface.
9.2. AI Output can be wrong, incomplete or misleading. It describes what a model infers from a thumbnail and a caption, and it does not verify, endorse or fact-check the content behind an Item. Do not rely on AI Output as advice of any kind — medical, legal, financial, or otherwise — and do not treat it as a statement of fact about the Item or its author.
9.3. AI Output is stored in your Library and is yours to keep, edit or delete like any other part of an Item. We claim no ownership of it. Because it is machine-generated, it may not be protected by copyright, and identical or similar output may be produced for other users.
9.4. Conversation mode answers only from Items in your own Library. Where nothing in your Library matches your question, Etch says so rather than answering from general knowledge.
9.5. You are responsible for how you use AI Output, including anything you republish from it.
10. Third-party platforms and trademarks
10.1. Etch is not affiliated with, endorsed by, sponsored by or connected to Instagram or Meta Platforms, TikTok or ByteDance, or YouTube or Google. Those names, logos and trademarks belong to their respective owners and are used on this page and in the App only to identify which links Etch can read, as nominative reference and nothing more.
10.2. Your use of a Platform is governed by that Platform's own terms, and by your relationship with it, not by these Terms.
10.3. We do not control what a Platform publishes, keeps online or removes. An Item stops opening when the post behind it is deleted, made private or restricted by the Platform, and there is nothing we can do about that. What remains is the metadata and thumbnail Etch copied when you saved it.
10.4. We do not host, publish or make available any content from a Platform. What Etch stores is stored in your own iCloud account and is visible only to you.
11. Availability and defects
11.1. Etch depends on services we do not control: Apple's, Cloudflare's, and the public pages of the Platforms. Those Platforms change their pages without notice, and reading them can stop working until we correct it.
11.2. We do not promise uninterrupted availability, and we do not promise that every Link will always resolve. We do undertake to correct, within a reasonable period, defects that are ours to correct.
11.3. Your statutory guarantees are unaffected. Articles 18, 20, 24 and 26 of the CDC apply to Etch regardless of what this page says, and nothing in these Terms waives, reduces or attenuates them.
12. Suspension and termination
12.1. We may suspend or terminate your access to Etch's servers if you breach clause 5, or if we are required to do so by law or by a court order.
12.2. We have no way to write to you. Sign in with Apple gives us an opaque identifier and no contact details, as the Privacy Policy explains, so the App itself is the only channel we have: where it can show the reason for a suspension, it does. Otherwise, write to contact@useetch.com and we will give you the reason and, where the breach can be corrected, a reasonable opportunity to correct it before the suspension becomes permanent.
12.3. Suspension or termination does not delete your Library. It is in your own iCloud account and it remains yours, together with the App's local features, including search over the Items already saved. What stops is access to the services we run: reading new Links and generating AI Output.
12.4. If we terminate your access while you hold a paid subscription, and the termination is not the result of your breach, cancel the subscription under clause 7.7; we will not oppose a refund request you make to Apple for the remaining paid period.
12.5. You may stop using Etch at any time. Signing out never deletes your Library. Deleting your account, from the account screen in the App, deletes both the record we hold and your Library on every device, after a confirmation that counts what will go; this cannot be undone.
13. Intellectual property in Etch
13.1. Etch — the App, its source code, its interface, its name and its logo — belongs to NuHouse and is protected by Federal Law No. 9.610/1998 (Copyright) and Federal Law No. 9.609/1998 (Software).
13.2. Subject to these Terms and to Apple's licence referred to in clause 7.12, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own personal use. No other right is granted.
14. Liability
14.1. Nothing in these Terms excludes, limits or attenuates any liability we owe you as a consumer under the CDC. A clause that did so would be void under article 51, I of the CDC, and we do not seek one. We are liable for damage caused by defects in Etch under articles 12 to 25 of the CDC.
14.2. What we are not responsible for is not a limitation of liability but a matter of what Etch does: we are not responsible for the content published on a Platform, for a Platform deleting, restricting or changing that content, for a Platform's or Apple's own services and their availability, for your iCloud account and its storage, or for anything you do with AI Output contrary to clause 9.
14.3. Neither party is liable for failure to perform caused by a fortuitous event or force majeure, under article 393 of the Civil Code.
14.4. If you are not a consumer — that is, if you use Etch in the course of a business activity and the CDC does not apply to you — our aggregate liability for all claims arising out of or relating to Etch is limited to the amounts you paid us for Etch in the twelve months preceding the event that gave rise to the claim, and we are not liable for lost profits or indirect damages. This clause 14.4 does not apply to consumers.
15. Changes to these Terms and to Etch
15.1. We may change these Terms. The "Last updated" date at the top always reflects the version in force.
15.2. Where a change materially affects what you receive or what you pay, we will say so in the App before it takes effect, and the change will apply from the start of your next subscription period. If you do not accept it, cancel under clause 7.7 before that period begins; cancelling for this reason carries no penalty. Continuing to use Etch after a change takes effect is acceptance of it.
15.3. We may change, add to or discontinue features of Etch. Where we discontinue a feature that Etch Pro included, and no equivalent replaces it, you may cancel under clause 7.7 and request a refund from Apple for the remaining paid period, which we will not oppose.
16. Governing law and forum
16.1. These Terms are governed by the laws of the Federative Republic of Brazil, in particular the CDC, the Civil Code and the Marco Civil da Internet.
16.2. If you are a consumer, you may bring a claim in the courts of your own domicile, under article 101, I of the CDC. This choice is yours and we do not restrict it.
16.3. If you are not a consumer, the courts of Joinville, Santa Catarina, Brazil have exclusive jurisdiction.
17. General
17.1. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in force, and the invalid provision is to be read so as to come as close as the law allows to its original purpose.
17.2. No waiver. Our failure to enforce a provision is not a waiver of it, and does not prevent us from enforcing it later.
17.3. Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition or transfer of the business, provided the assignment does not reduce your rights under these Terms or under the CDC; we will announce such a transfer in the App before it takes effect.
17.4. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding Etch, and replace any earlier version. They do not affect your separate agreements with Apple or with any Platform.
17.5. Language. These Terms are published in English and in Portuguese at the same address, served according to your language settings. For consumers domiciled in Brazil, the Portuguese version prevails, as article 31 of the CDC requires information to be given in Portuguese.
